It filled me with pleasure to be asked by Problema editor-in-chief Sandra Gómora Juárez to lead a discussion on the theories and doctrine on precedent in our context alongside Prof. Marina Gascón Abellán. Besides the undeniable and recognized prestige of the Problema journal, there was also the possibility of working with Prof. Marina Gascón again and with Sandra Gómora for the first time. It was also an opportunity to discuss issues regarding precedent with old friends (...) like Flavia Carbonell, Fabio Pulido and Silvia Zorzetto, and exchange opinions with new ones like Rodrigo Camarena. On this occasion, I would like to comment specifically on the works of Prof. Fabio Pulido Ortiz and Prof. Silvia Zorzetto, both of which are of unquestionable quality. The article by Prof. Pulido Ortiz of the Universidad de la Sabana in Colombia is a work of analytical finesse and subtlety that discusses some fundamental problems of legal theory from the standpoint of the theory of precedent. Prof. Silvia Zorzetto from Università Statale di Milano has conducted an analytical and metalinguistic survey of the use of precedents in Italy, particularly at the Italian Sezioni Unite Civili della Corte di Cassazione. This work is priceless not only in terms of its value as a study of (internal) Italian legal culture, but also because the analysis can be generalized, at least in part, to explain how precedents are used in civil law systems. Cuando la profesora y directora de la revista Problema, Sandra Gómora Juárez, nos propuso a la profesora Marina Gascón Abellán y a mí llevar a cabo una discusión acerca de las teorías y doctrinas del precedente en nuestro contexto, no me pude sentir más contento. Al indudable y reconocido prestigio de la revista Problema se sumó la posibilidad de volver a trabajar con la profesora Marina Gascón y hacerlo por primera vez con Sandra Gómora. Además, (...) surgió la oportunidad de volver a discutir con viejos amigos —como Flavia Carbonell, Fabio Pulido, Silvia Zorzetto— sobre cuestiones relativas al precedente, y poder contrastar opiniones con otros nuevos, como Rodrigo Camarena. En esta ocasión, me corresponde comentar, en particular, los trabajos del profesor Fabio Pulido Ortiz y de la profesora Silvia Zorzetto. Ambos trabajos son de una indudable calidad. El del profesor Pulido Ortiz, de la Universidad de La Sabana de Colombia, es un trabajo de finura y sutileza analítica que entra a discutir, al calor de la teoría del precedente, algunos problemas fundamentales de la teoría del derecho. La profesora Silvia Zorzetto, de la Università Statale di Milano, ha llevado a cabo un reconocimiento analítico y metalingüístico de la práctica de los precedentes en Italia, con especial atención a le Sezioni Unite Civili della Corte di Cassazione italiana, de incalculable valor. Ello no sólo por el valor que pueda tener para el estudio de la cultura jurídica (interna) italiana, sino porque su análisis puede ser, al menos en parte, generalizado para dar cuenta de cómo son usados los precedentes en los ordenamientos de civil law. In this paper I pursue an avenue of argument implicit in Patristic thinkers — such as Tertullian and Athanasius — and explicit in the thomistic and scholastic tradition. I argue that there is an ontological unity to the world, and that this unity calls for an explanation in terms of a transcendent cause, traditionally identified with God.

Empoderar el inglés por medio del sistema dual y las diferentes especialidades, es una tarea que el área de idiomas ha tratado por mucho tiempo de llevar a cabo por medio de la inserción del inglés técnico al programa de inglés general que el MCCEMS oferta, aún sin éxito. Es por eso por lo que se elabora esta propuesta de reajuste para la materia de inglés, en cuanto a dosificación de temas (reestructuración al MCCEMS), en cuanto a número de horas (...) clase (derivado del acuerdo 653, se pretende un incremento de horas para el sexto semestre y por lo menos 1 para los semestres que ya cuentan con la materia), en cuanto a contenidos específicos (inserción del vocabulario técnico y desenvolvimiento en las áreas de especialidad con el uso del idioma), lo que es el saber hacer con el inglés dentro su entorno trabajando más a profundidad el trabajo por competencias. Para lograr dicho objetivo se requiere a docentes de inglés especializados en las distintas áreas que se ofertan, en los distintos centros educativos de los subsistemas de EMS, así mismo que brinden mayor tiempo dentro del aula para garantizar que dicho aprendizaje sea exitoso, iniciando primeramente con los alumnos de sistema Dual por estar más en contacto con las unidades económicas y en un segundo paso al resto de los alumnos. Todo esto para tener mayor número de egresados certificados en el idioma con dominio de su área de especialidad. (shrink)

Thomas Hobbes has been hailed as the philosopher of power par excellence; however, I demonstrate that Hobbes’s conceptualization of political power is not stable across his texts. Once the distinction is made between the authorized and the effective power of the sovereign, it is no longer sufficient simply to defend a doctrine of the authorized power of the sovereign; such (...) a doctrine must be robustly complemented by an account of how the effective power commensurate to this authority might be achieved. Nor is this straightforward: for effective political power can fluctuate, sometimes severely. In this light, the prevalent juridical reading of Hobbes’s political philosophy is inadequate. (shrink)

Therefore, the systematic side of Plotinus’ thought (...) is here viewed as the really suitable mode, way or “mothodology” to think the Totality as a supreme unity, and to express the One’s ontology as a perfect whole. According to this interpretation, the system reflects the “synoptical” view of its same content, and shows it as the One’s “presence” in the whole reality and in the Plotinus’ intuitive mind, developed through an ordered series of concepts, in view of the mystical experience, to the union with the One, as the final goal. Die Freie Musikszene war, im Gegensatz zum Freien Theater, in Deutschland bisher kaum Gegenstand kulturpolitischer Debatten. In Statistiken uber die Musikforderung in Deutschland wird sie nur selten gesondert aufgefuhrt, da ihre offentliche Unterstutzung im Vergleich zur Forderung von Musiktheatern und Sinfonieorchestern verschwindend gering ist. Ziel dieser Studie ist es, das Phanomen Freie Musikszene naher zu beschreiben, ihren Stellenwert in der deutschen Musiklandschaft zu diskutieren und mogliche Entwicklungsperspektiven aufzuzeigen. Basierend auf Experteninterviews, die in den drei Stadten Hamburg, Koln und Freiburg im (...) Breisgau einerseits mit Vertretern international renommierter Spezialensembles und andererseits mit verantwortlichen Kulturpolitikern gefuhrt wurden, werden die finanziellen und organisatorischen Strukturen verschiedener Spezialensembles fur Alte und Neue Musik beschrieben, nach dem kunstlerischen Potential der Freien Musikszene gefragt und kulturpolitische Handlungsempfehlungen formuliert.". Resumen. La presente investigación busca diseñar un modelo estratégico de formación de servidores públicos que propicie el crecimiento personal y profesional, encaminado al servicio civil de carrera. Apoyándose en criterios, conceptos y estrategias propios de Administración del Capital Humano, y Aprendizaje Organizacional aplicándolas al contexto de la Administración Pública Estatal. Para alcanzar este propósito se realizó un diagnóstico con beneficios claros, que dan la oportunidad de pensar y dialogar sobre la estrategia, los objetivos, las personas y el futuro de la (...) Administración Pública Estatal Sinaloense desde una perspectiva del conocimiento. El trabajo de campo se realizó con personal que presta sus servicios en entidades y dependencias administrativas públicas pertenecientes al Poder Ejecutivo del Gobierno del Estado de Sinaloa. A través de un cuestionario, con una muestra de 400 individuos. Se han obtenido 29 indicadores cuyos valores reflejan donde reside el valor del Capital Humano. Así como una puntuación total alcanzada de 104 puntos, advirtiéndose que en el área de gestión del conocimiento, es necesario hacer “algo” para que esta administración, sea considerada como una organización que aprende en toda regla y que realiza una gestión del conocimiento de forma óptima y eficaz. The present research pretends to design a strategic model to train public servants to help to develop both professional and personal growth, headed to civil service as a profession. Based on criteria, concepts and strategies from Human Capital Administration and Organizational Learning, applying these to the State Public Administration’s context. To achieve this goal, a diagnose took place with clear benefits, that give, to us all, the chance to think and discuss about strategies, objectives, people and future of the Sinaloa State Public Administration from a knowledge perspective. Fieldworkwas done by personnel that serve in administrative public entities and organizations that are part of the Executive Power of the Sinaloa State Government. Through a questionnaire, with a sample of 400 individuals, there was a result of 29 indicators, and its values reflect where the importance of the Executive Power of the Sinaloa State Government lies, as well as a reached total score of 104 points. Noting that in the knowledge promotion area it is necessary to do something so this administration would be considered an organization that learns with every rule and performs a knowledge management in an optimum and efficient way. Alumnos con discapacidad: modelo de inclusión de la Universidad Federal de San Carlos Resumen: El objetivo fue describir cómo funciona el programa de inclusión para alumnos con discapacidad en la Universidad Federal de San Carlos, en Brasil. Es una investigación cualitativa con análisis del discurso de cuatro entrevistas semiestructuradas con alumnos con discapacidad, investigadores especialistas y gestores. Los principales resultados muestran que no es suficiente trabajar sobre los ejes de atención a estos estudiantes sino se analizan y evalúan las funciones (...) de los actores involucrados en el proceso de inclusión. Es necesaria una estructura que promueva cambios culturales en la comunidad universitaria, de otro modo, las barreras actitudinales siguen siendo uno de los principales límites para estos alumnos. Students with disabilities: inclusion model of Federal University of São Carlos Abstract: The objective of the study is to describe the inclusion program for students with disability in the Federal University of São Carlos, in Brazil. A qualitative study based on discourse analysis of four semi-structured interviews with students with disability, specialist researchers, and managers. The main results shows that is not enough to focus on the principal subjects of inclusive education, instead, it’s necessary to analyze responsibilities of every actor involved in the inclusion process, motivation based structure is needed towards a cultural change. Otherwise, attitudinal barriers of the university community continue to be one of the principal limits for these students. ABSTRACT:This article assesses the proliferation of international accountability standards (IAS) in the recent past. We provide a comprehensive overview about the different types of standards and discuss their role as part of a new institutional infrastructure for corporate responsibility. Based on this, it is argued that IAS can advance corporate responsibility on a global level because they contribute to the closure of some omnipresent governance gaps. IAS also improve the preparedness of an organization to give an explanation and a justification (...) to relevant stakeholders for its judgments, intentions, acts and omissions when appropriately called upon to do so. However, IAS also face a variety of problems impeding their potential to help address social and environmental issues. The contribution of the four articles in this special section is discussed in the context of standards’ problems and opportunities. The article closes by outlining a research agenda to further develop and extend the scholarly debate around IAS. (shrink)

The pandemic has exposed the costs of job and income losses. Emergency cash transfers can mitigate the worst immediate effects on people who lack access to safety nets. This research note provides estimates for a potential Temporary Basic Income for poor and near-poor people across 132 developing countries, as well as the minimum cost of income support sufficient to mitigate the pandemic-induced poverty increase. The total monthly cost of the TBI ranges 0.27–0.63% of developing countries’ combined GDP, depending on the (...) choice: top-ups on each country’s average incomes up to a vulnerability threshold; transfers based on each country’s median standard of living; or uniform transfers. This note argues that some form of TBI is within reach and can inform a larger conversation about how to build comprehensive social protection systems that make the poor and near-poor more resilient to economic downturns in the future. In a rare full-length volume, renowned feminist thinker Sandra Lee Bartky brings together eight essays in one volume, Sympathy and Solidarity. A philosophical work accessible to an educated general audience, the essays reflect the intersection of the author's eye, work, and sometimes her politics. Two motifs connect the works: first, all deal with feminist topics and themes; second, most deal with the reality of oppression, especially in the disguised and subtle ways it can be manifested.

The world is complex, but acknowledging its complexity requires an appreciation for the many roles context plays in shaping natural phenomena. In _Unsimple Truths, _Sandra Mitchell argues that the long-standing scientific and philosophical deference to reductive explanations founded on simple universal laws, linear causal models, and predict-and-act strategies fails to accommodate the kinds of knowledge that many contemporary sciences are providing about the world. She advocates, instead, for a new understanding that represents the rich, variegated, interdependent fabric of many levels (...) and kinds of explanation that are integrated with one another to ground effective prediction and action. Mitchell draws from diverse fields including psychiatry, social insect biology, and studies of climate change to defend “integrative pluralism”—a theory of scientific practices that makes sense of how many natural and social sciences represent the multi-level, multi-component, dynamic structures they study. She explains how we must, in light of the now-acknowledged complexity and contingency of biological and social systems, revise how we conceptualize the world, how we investigate the world, and how we act in the world. Ultimately _Unsimple Truths _argues that the very idea of what should count as legitimate science itself should change. (shrink)

Poor quality medical care is sometimes attributed to physicians’ unwillingness to act on evidence about what works best. Evidence-based performance standards (EBPSs) are one response to this problem, and they are increasingly employed by health care regulators and payers. Evidence in this instance is judged according to the precepts of evidence-based medicine (EBM); it is probabilistic, and the randomized controlled trial (RCT) is the gold standard. This means that EBPSs suffer all the infirmities of EBM generally—well rehearsed problems with the (...) external validity of research findings as well as the inferential leap from study results in the aggregate to individual patient care. These theoretical weaknesses promise to have a practical impact on the care of patients. To avoid this, EBPSs should be understood as guidelines indicative of average effectiveness rather than standards to be applied in every case. (shrink)

Plato believed that behind everything in the universe lie mathematical principles. Plato was inspired by Pythagoras (571 BCE), who developed a school of mathematics at Crotona that studied sacred geometry as a form of religion. The school’s motto was “God is number,” or “All is Number”. Pythagoras believed that numbers represented God in pattern, symmetry, and infinity. When one of its students, Hippasus told the world the secret of the existence of irrational numbers, Greek geometry was born and Pythagoras’ idea (...) of divinity in numbers died because how could God not be perfect and symmetrical? In Plato’s Republic he discusses something called The Divided Line, which is a map, of sorts, for reaching what he calls the highest Good, which is the ultimate truth where one realizes the true state of the universe and can see the world for what it really is. Many mathematicians have attempted to plot Plato’s Divided Line only to come across a litany of problems and conundrums. Some have said that it the Divided Line cannot be plotted and is merely an allegory not meant to be plotted. This paper discusses some of the conundrums preventing the plotting of Plato’s Divided Line (not an exhaustive list), including Whole ‘vs’ Separate, Equality ‘vs’ Ontological Dissimilarity, Linear ‘vs’ Non-linear, and Infinity ‘vs’ Finite. This paper also explores a new understanding of the Allegory of the Cave in light of ‘the problem of the irrational.’ In exploring the link between the Divided Line and the ‘the problem of the irrational,’ I was able to plot it. It was found that the Divided Line is not a line in the linear sense, but a spiral, the Golden Ratio! This paper is an example of a new category of scholarly inquiry I call “Math Theory” based on scholarly mathematical axioms in theory, rather than including actual maths. In my papers I use existing mathematical equations and place them in an encompassing theory, rather than finding new formulae to fit an existing theory.
